1. Scope of Services

Total Pro Services LLC. provides professional HVAC services, including:

  • Mini split installation, repair, and maintenance

  • System sizing, consultation, and troubleshooting

  • Any ancillary services agreed upon in writing

All work is performed by licensed, insured technicians. Customers acknowledge that service scope is limited to what is described in the quote or agreement.

2. Quotes, Estimates & Approvals

  • All services require a written quote or estimate prior to commencement.

  • Prices may vary based on unit size, number of indoor units, installation complexity, existing electrical or structural conditions, or other site-specific factors.

  • No work begins without customer approval of the quote.

  • Quotes are valid for 30 days unless otherwise stated.

  • Any additional work outside the original quote requires written authorization.

3. Payments

  • Payment is due as stated in the service agreement.

  • Accepted payment methods: Cash, Check, ACH Transfers, Credit Card (3.5% Fee for all Credit Card Transactions)

  • Late payments are subject to interest and collection fees.

  • Service may be suspended or withheld until payment is received.

4. Customer Responsibilities

Customers must:

  • Provide safe and clear access to all work areas.

  • Inform us of any pre-existing conditions that could affect work.

  • Ensure compliance with local codes, permits, or HOA requirements.

  • Follow manufacturer instructions for system use and maintenance after service.

5. Warranties & Disclaimers

  • We warrant that our services will be performed professionally and competently.

  • Product warranties are provided by the manufacturer only; Total Pro Services LLC. is not responsible for defects or failures of equipment.

  • Services are provided “as is”, except as explicitly stated in the written agreement.

  • We are not liable for damages caused by improper use, neglect, or unauthorized modifications.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Total Pro Services LLC. shall not be liable for indirect, incidental, consequential, or punitive damages, including lost profits or property damage.

  • Our total liability is limited to the amount paid by the customer for the services performed.

  • Customers acknowledge that HVAC systems involve inherent risks, and agree to hold Total Pro Services LLC. harmless from claims arising from misuse, force majeure, or environmental conditions beyond our control.

7. Cancellations & Rescheduling

  • Appointments may be cancelled or rescheduled with at least 24 hours’ notice.

  • Cancellations within 24 hours may incur a cancellation fee.

  • Missed appointments without notice may result in full or partial charge.

8. Governing Law & Dispute Resolution

  • These Terms of Service are governed by the laws of the State of Kansas.

  • Any dispute arising from these Terms or services must be resolved in the courts of Spring Hill, KS and the customer consents to jurisdiction there.

  • Customers agree to mediation or arbitration prior to litigation where possible.

9. Acknowledgment

By engaging our services, the customer acknowledges that they:

  • Have read, understood, and accepted these Terms of Service

  • Agree to the limitations, disclaimers, and payment terms stated herein
